We The People Glendale reserves the right to change this website and these Terms of Use at any time without notice to you by posting such changes to this website. These Terms and Conditions (also referred to as “Terms of Use”, “Site Terms” and “Agreement” herein) apply exclusively to Users’ access to, and use of, this website operated by We The People Glendale located at www.wethepeopleglendale.com (the “Site”) and the information and other services provided therein (the “Services”). These Site Terms do not alter the terms or conditions of any other agreement Users may have with We The People Glendale, for products, services or otherwise. If Users are using the Site on behalf of any entity, Users represent and warrant that Users are authorized to accept these Site Terms on such entity’s behalf, and that such entity agrees to indemnify Users and WTP for violations of these Site Terms.
Definitions
- “Terms of Use”, “Terms and Conditions,” “Site Terms,” and “Agreement” all mean these Terms and Conditions;
- “WTP,” “us,” “we,” “our,” and any other reference made in the first person means We The People Glendale;
- The “Site” means this website operated by We The People Glendale, at web address (URL) www.wethepeopleglendale.com
- The “Services” means all services provided by We The People Glendale to all users of the Site;
- “Users” and “Clients” means those users of the Site holding themselves out on the Site as being legal persons or entities looking for and needing legal document preparation services, and accepting these Site Terms and Agreement;
Definitions of additional terms are included in throughout these Site Terms and those additional terms shall have the definitions attributed to them therein; all words, terms, and phrases not defined in these Site Terms shall be given their commonly understood meaning.
Purpose of the WTP Site
The Site provides a directory of services offered by We The People Glendale, including divorce, legal separation, child support, child custody, living trusts, deeds, name changes, incorporation/LLC, trademarks, evictions, bankruptcy, small claims, notary services, and more.
Eligibility
The WTP Site is available only to legal entities and persons who are at least eighteen (18) years old and are otherwise capable of forming legally binding contracts under applicable law. User agrees that User is not (a) a citizen or resident of a country in which use or participation is prohibited by law, decree, regulation, treaty or administrative act; (b) a citizen or resident of, or located in, a country or region that is subject to U.S. or other sovereign country sanctions or embargoes; or (c) an individual or an individual employed by or associated with an entity identified on the U.S. Department of Commerce’s Denied Persons or Entity List, the U.S. Department of Treasury’s Specially Designated Nationals or Blocked Persons Lists, or the Department of State’s Debarred Parties List or otherwise ineligible to receive items subject to U.S. export control laws and regulations, or other economic sanction rules of any sovereign nation.
User Obligations
Users will not access or attempt to access the Site by any means other than the interface provided, and will not use information from the Site for any purpose other than the purpose for which it was made available. Users will not engage in any activity that interferes with or disrupts the functioning of the Site. Users will not upload or attach invalid, malicious, or unknown files to the Site. Users will not insert any external links that are malicious or unknown to Users, or used for offering any goods or services other than the services for which the Site is intended. Users agree not to scrape, take, or acquire data from the Site, whether by manual or automated means, for any commercial, marketing, or data compiling or enhancing purpose, or to copy, re-post or re-use data from the Site for any other service. Users agree not to use or provide software, except for general purpose web browsers and email clients, or software expressly licensed by WTP, or services that interact or communicate with the Site for downloading, uploading, posting, flagging, emailing, search, or mobile use.
Materials included on this site are for informational and personal purposes only. Users agree they will not copy, distribute, publish, transmit, modify, display or create derivative works from or exploit the contents of this site in any way without prior written consent from WTP. Users agree to indemnify, defend and hold harmless WTP and its affiliates for any and all unauthorized uses as you may make of any material on this site. Users may, however, make one copy of any material on this website for personal, non-commercial use provided that they neither modify nor alter the material in any way, nor delete or change any copyright or trademark notice. WTP reserves all right, title and interest in and to all intellectual property rights for materials copied from this website. WTP provides the content of this website for lawful purposes only.
Consent to Receive Emails
By using the Site, Users consent to receive emails from We The People Glendale, which may include commercial emails. Users may “opt out” of receiving service or account-related emails from We The People Glendale by clicking the “unsubscribe” link in any received email.
Copyright and Limited License
Unless otherwise indicated, the Site and all content and other materials on the Site, including, without limitation, the WTP logo, and all designs, logos, text, button icons, graphics, pictures, reviews, information, data, software, sound files, other files and the selection and arrangement thereof (collectively, the “Site Materials”) are the proprietary property of WTP or its licensors or Users and are protected by U.S. and international copyright laws. Unless otherwise noted, all
materials on this site are protected as the copyrights, service marks and/or other intellectual properties owned by WTP or by other parties that have licensed their material to WTP. No license to use any of these marks is given or implied. These marks may not be copied, downloaded, reproduced, used, modified or distributed in any way.
Users are granted a limited, non-assignable license to access and use the Site and electronically copy, (except where prohibited without a license) and print to hard copy portions of the Site Materials for Users’ informational, non-commercial and personal use only. WTP does not endorse or adopt any Third Party Content or third party website and can make no guarantee as to its accuracy or completeness. WTP does not represent or warrant the accuracy of any information contained therein and undertakes no responsibility to update or review any Third Party Content or third party websites. No Practice of Law
WTP does not practice law, nor offer to practice law, nor provide legal services in any jurisdiction whatsoever.
Indemnification by User
Each User shall defend, indemnify, and hold harmless the Indemnified Parties from any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys’ fees and all related costs and expenses) arising from or relating to information or services provided, or actions taken, by that User.
Term and Termination Term
The term of this Agreement commences on the Effective Date and continues in effect until terminated in accordance with the below.
Termination
WTP may terminate this Agreement or Users use of the Site at any time, with or without cause, effective immediately without written notice to the Users.
Consequences of Termination
Termination shall not relieve Users of the requirement to pay for use of the Site incurred prior to the effective date of the termination.
Entire Agreement
These terms and conditions constitute the entire agreement between WTP and you regarding this website. These terms and conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between WTP and you regarding this website. No modification of these terms and conditions will be effective unless WTP authorizes it. If any part of these terms and conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of remaining provisions.
Compliance
Users shall not violate any laws or third party rights on or related to the use of the Site. Without limiting the generality of the foregoing, Users agree to comply with all applicable import and export control laws and third parties’ proprietary rights.
Notices: Consent to Electronic Notice
Users consent to the use of (a) electronic means to complete this Agreement and to deliver any notices pursuant to this Agreement; and (b) electronic records to store information related to this Agreement or Users’ use of the Site.
Modifications
No modification or amendment to this Agreement shall be binding upon WTP unless in a written instrument signed by a duly authorized representative of WTP. A written instrument shall expressly exclude electronic communications, such as email and facsimiles.
No Waiver
The failure or delay of WTP to exercise or enforce any right or claim does not constitute a waiver of such right or claim, and shall in no way affect its right to later enforce or exercise it, unless it issues an express written waiver, signed by a duly authorized representative of it.
Assignability
Users may not assign this Agreement, or any of its rights or obligations here under, without WTP’s prior written consent in the form of a written instrument signed by a duly authorized representative of WTP (a written instrument shall expressly exclude electronic communications such as email and facsimiles). WTP may freely assign this Agreement without consent of Users. Any attempted assignment or transfer in violation of this Section will be null and void. Subject to the foregoing restrictions, this Agreement will inure to the benefit of the successors and permitted assigns of WTP.
Severability
If and to the extent any provision of this Agreement is held illegal, invalid, or unenforceable in whole or in part under applicable law, such provision or such portion thereof shall be ineffective as to the jurisdiction in which it is illegal, invalid, or unenforceable to the extent of its illegality, invalidity, or unenforceability, and shall be deemed modified to the extent necessary to conform to applicable law so as to give the maximum effect to the intent of the parties. The illegality, invalidity, or unenforceability of such provision in that jurisdiction shall not in any way affect the legality, validity, or enforceability of such provision in any other jurisdiction or of any other provision in any jurisdiction.
Applicable Law and Jurisdiction
This website is created, controlled, and operated by We The People Glendale in the state of California, United States of America. The laws of the State of California will govern these terms and conditions, without giving effect to any principles of conflicts of laws. For any legal action concerning these terms and conditions or this website, you irrevocably consent to the jurisdiction and venue of state or federal courts located in Los Angeles County in the State of California, and you must bring any such legal action within such venue within one (1) year after the claim or cause of action arises. If you access this website from outside of the United States of America, then you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
Dispute Resolution; Arbitration; Personal Jurisdiction and Venue
We The People Glendale and Users hereby agree that any Claims shall first be settled through negotiation. If a Claim (other than a Claim for injunctive or other equitable relief) remains unresolved by these means, WTP will have the right to demand binding, non-appearance based arbitration by a third party service selected by WTP. The arbitration shall take place in the State of California, and in the event the parties cannot agree on a third party service or an arbitrator, WTP shall have the right select the third party service and/or the arbitrator. A final judgment will be made by the arbitrator, which must be adhered to by all parties. Users agree that any Claim Users may have against WTP, if not resolved as set forth above, must be resolved by the California state courts (or, if there is exclusive federal jurisdiction, the United States District Court for the Central District of California). Users hereby irrevocably consent to the personal jurisdiction and venue of these courts.
Prevailing Language
The English language version of this Agreement shall be controlling in all respects and shall prevail in case of any inconsistencies with translated versions, if any.
